According to Eli Carpio, a seasoned expert in real estate transactions, title companies are crucial in verifying that a property’s title is free of liens and encumbrances before a sale. He highlights the importance of thorough checks and balances to prevent future legal disputes and financial losses. Eli Carpio 2:13
Pretty good man. Thank you for having me.
Yoni Schmidt 2:16
Yeah, of course. Love it Eli. Let’s kind of just like, dive right in. Tell us. Tell us about, you know, starting, what inspired you to start Empire Title & Closing and, you know, what’s your vision for the company?
Eli Carpio 2:30
Yeah, man. So, you know, I gotta say, over a little bit a year ago, this wasn’t even in my plans to start. This is just something that really fell into our lap and and and we just, you know, just went with it. And, you know, as the months progressed, we were like, Hey, this is looking like something we we really, really want to do now. And, you know, my wife’s not here, but she’s, she’s the brain of the operation over at Empire Title. And so, you know, I kind of just just connected the pieces her with my network, and, you know, her network as well, and and we made this happen. You know.
Yoni Schmidt 3:09
Yeah, we should have her join as well. But, you know, I know you and her work together with also the brilliant Jeanette Figueroa, right, who is now at Empire, who’s done a bunch of closings for us. I think she even closed my personal, my first personal residence in Tulsa, you know, back when she was with another title company. But, you know, going through this process, what were the what unique challenges did you face, and how did you overcome those?
Eli Carpio 3:41
Yeah, man. I mean, it was totally something new, right? So, you know, you have your investing side, and you have the the whole flipping and buying rentals and and, you know, and what you do as well, and then, and then you have this side, right, which is a totally different monster, you know, I think as the months went on, I noticed like, Hey, this is a lot like, this is, you know, there’s a lot of law, there’s a lot of like, you know, you have to be very like detailed in everything that you do. You know, it’s not like investing, right? If you drop the ball here, well, it’s no big deal. Like, there’s other ways to do it. Like, in title, you only get one shot really, you know, because you don’t want to mess up anybody’s file or, or anyone’s, you know, property that they’re buying, like, especially if it’s their first time, you know, because we not only do investors, we also do first time homebuyers and all that stuff. So, you know, as it went on, you know, we just really had to be on our P’s and Q’s and, and, you know, it just, it just really opened up a whole another world, and we got to see the whole other side of real estate that we’ve never seen, even Jeanette like, you know, she’s been closing for a long time. But being an owner now and seeing the backside of a title company was was a totally new, different challenge, and and we welcome. Did, and, you know, we’re, we’re just moving forward, man.
Yoni Schmidt 5:04
Yeah. I mean, that’s awesome. You got to just take it with stride, right? And go for it, and be outside of your comfort zone for sure, to, you know, achieve some growth, I guess, for those that are listening who are maybe a little bit unfamiliar with title and closing and the process, right? Can you explain a little bit about why title companies exist and why they’re essential in the world of real estate, what you guys do, and maybe a little bit about how Empire is different?
Eli Carpio 5:34
I mean, yeah, they exist because, I mean, you know, you want to make sure, when you’re buying a property, right, that everything’s good to go. You want to make sure your title’s good your you know, we live in an Abstrakt state, so we want to make sure all the abstracts are up to date and everything’s being done correctly. So, you know, a lot of people, they’ll buy a property, they’ll go to the assessor, and they’ll just deed a house over, right? But you you really don’t know what you’re getting yourself into, unless you close with a title company. Basically, right? We also ensure our work, obviously, with title insurance, and making sure that you know if anything were to fall back on the property. You’re, you’re, you know, we take the full responsibility for it. We also make sure just your transaction goes smooth. If you have a lender, if you have partners, we make sure that operating agreements are where they need to be. We need to, you know, we make sure that the LLC selling the property, or the person selling the property is is able to sell the property right, that there’s no means or judgments or anything like that. So there’s, there’s, there’s just so much that people, you know don’t understand when it comes to buying a house and making sure your transaction is clean and smooth. So and then, you know, as far as empire, I mean, the way we differ is, I’m an investor, you know, Jeanette also an investor. Owns rental properties. We also have the brilliant Shawna Lee, who handles all the investment side, which she actually used to wholesale as well. So she knows the ins and in and outs of being an investor and making sure that you know all paperwork are delivered on time, because as investors, that’s how you make money. So we don’t want at Empire, we don’t want to delay any of that for you, you know, right? So, and then also the bilingual side, right? We have two bilingual agents at Empire. I’m very passionate about the Latino community, which as well. So that was always my day one. I want to make sure that Latinos know, even if they don’t speak English like I want to make sure that they know what they’re signing, they know what they’re buying, they know what they’re getting themselves into from the lender side and from the buyer side. So that’s a big passion of ours, and we’re looking to expand that, you know, here in the future as well.
Yoni Schmidt 8:04
Yeah, nice, awesome. That’s a huge that’s a huge win, because I don’t think there are many title companies in the area that offer that bilingual service that I’m aware of. Yeah, nice, can you, I guess, describe a, you know, what’s a typical day like for the CFO at the Empire Title & Closing?
Eli Carpio 8:28
Yeah, man. I mean, usually, you know, it’s just every day collecting some data, seeing how many, how many files we have in the pipelines, to close for the week, you know, also making sure that, you know, all escrow accounts are, you know, ready to go, making sure that the deals that are being closed that week or that day are being already funded. So, updating spreadsheets, expenses, company, credit cards. I mean, it’s, it’s just, you know, because as a title company, especially as a newer title company, we, you know, we’re taking clients out to lunch. We’re donating money here. We’re big on community, so really give back. And we’ve already started giving back a lot, so, you know, making sure that all that’s being done, all the right checks are being written out, and, of course, within staying in our compliance, right? So, so that’s very important. And like I said, updating spreadsheets and just making sure we’re we’re on budget for that month, and so that’s gotta do it every day.
Yoni Schmidt 9:39
Yeah? Do you know, and this is from my own education, really, I’m not, I’m not too sure, or, or I don’t know much about, you know, starting a title company. I know a little bit about title because I’ve done many transactions, and, you know, I’ve seen, I’ve seen the process, not on behind the scenes, but most. Yes, most title companies, I guess, work with attorneys, correct? And does Empire have attorneys on staff?
Eli Carpio 10:09
We do, yes, yeah, yeah, we have one attorney on staff, and he’s been there since day one.
Yoni Schmidt 10:15
So, so, yeah, so what do those attorneys do? Right? They tell us a little bit about that.
Eli Carpio 10:23
Yeah. So he’ll review the abstract, make sure abstract is good. He’ll clear title work, make sure all that that is good as well. He also will do things like probates. He’ll also do land trust for investors who need it, you know, for like a subject to or something like that. And, you know, along along with, with, with other, with other things that you know, the real estate world needs of him, right? I mean, I can’t think of what’s the other one that’s pretty important.
Yoni Schmidt 10:58
I guess, tell me, if say, for example, you know, the abstract is missing on a transaction, right? Have you dealt with that one before? I mean, I’m sure you’ve Yeah, yeah, yeah. What happens in that case? Right? I mean, it’s a bit more nuanced and complex. The attorney has to basically reconstruct the abstract.
Eli Carpio 11:17
So it’s not the attorney, it’s the abstract company, right? So, okay, they have to reconstruct the abstract, correct? And it’s, and it’s, it could get messy. It could take some time, you know, it depends too on what county it’s in, right? If it’s in, let’s call it Osage or Pawnee, or Washington, you know, it could take a little bit of time, especially in those smaller counties and Tulsa, it can be done pretty quickly, but it’ll still delay your closing.
Yoni Schmidt 11:48
Yeah, and the cost of something like that would be what a couple 1000 it could it varies greatly.
Eli Carpio 11:55
It varies greatly. Does I mean Tulsa? You’re probably looking any average between 500 and 750 bucks. The smaller counties outside will be a bit more money.
Yoni Schmidt 12:08
Yeah, more time consuming, of course. Yeah, yeah, interesting. So I guess to move on from that. How do you guys ensure you know, accuracy and efficiency and hand handling these, you know, complex documentation that involve the title and the processing. Yeah, it’s closing processes.
Eli Carpio 12:31
Man, it’s double checking your work, right? I’m very, with the girls like, hey, you know, I like that. Our girls are experienced. But, you know, even the top notch professional misses things all the time, right? So I say, Hey, girls, just make sure that you guys double check everything that you do. And one client is not more special than another, like we treat everybody evenly. So you know, like, Hey, I don’t care if it’s a 20 house package or if it’s just a first time homebuyer, double check your work make sure all your numbers are correct. You know, if you need another set of eyes to look at it, you know, if you guys gotta, you know, team up and look at it. If you’re not 100% sure, I want to make sure that everything that comes out of one of the closers hands is 100% sure. And so, yeah, we’ll have everything double checked and make sure the girls are they even have a checklist to make sure they’ve checked everything. Because sometimes, you know, you if you’re doing 2030 clothings at once, you forget, you’ll forget a couple things. I mean, you know. So they do have these checklists on their on their desks and on their computers that you know they they just make sure everything’s being done.
Yoni Schmidt 13:41
Yeah, awesome. Can you share, I guess, an example of a particularly challenging transaction that you know you had and how your team successfully navigated it. I’m sure you’ve seen this, you know, even before starting empire. And you know, as a buyer or as a seller, right? You sometimes you sell a home, and then you think, oh, you know, things are great, but maybe someone didn’t clear a divorce, you know, the divorce decree didn’t clear something on the title, and there’s a requirement, and now you have to go sign, find someone to sign, or someone signed something that they didn’t have authority to sign. That’s happened to me before, right? We were buying a house and from from a from large company, and someone signed, I think it was, maybe it was the deed, right? They signed over the deed few transactions ago, and they didn’t even have the authority to do that, right? Yeah, and you have to go find the person who has authority and have no resign it.
Eli Carpio 14:47
You know, which ones are the most difficult? For sure, is, I want to say the most difficult. I just think, I think if Jeanette was here or Shawna was here, they would say, it’s just a pain, right? It’s when. What about when mortgages get sold, right? And what about if the lien wasn’t cleared, like years ago, right? So now let’s say ABC mortgage was now sold off to caliper, and caliper sold it off to, you know, Carrington, and Carrington sold it off to JP Morgan and Chase, right? But you call that that bank, and they have no idea what you’re talking about, right? They’re like, Oh, wait a minute. Wait, how long ago was this? Oh, no, but we bought it from Carrington. Then they have to go and call Carrington. Oh, but, oh, we bought it from caliper. Oh, now they have to go call caliper, you know? And then caliber might be the one that has the lien release right on the Yeah, on the lien was paid off in 2008 right? Yeah, wow. Well, those, those things like that, we do come across quite often, all because it just wasn’t filed. But even though, you know the the seller knows, like, Hey, I mean, I own the house free and clear, you know, it’s, it’s and we believe them, it’s just, you gotta update the abstract, right? That’s gotta be in the abstract. I mean, yeah, for future sales, right? So I would say that happens quite often, where the mortgage has been sold off over and over and over and over again, and banks just fail to, you know, give a lien release. You know, that’s crazy.
Yoni Schmidt 16:19
What I mean, what’s the solution to something like that? Because then you, as the title company, you’re wasting a ton of time and human resources and capital to, you know, just get the runaround from these banks who, you know, someone just didn’t do their job and they didn’t file a lien release. I didn’t know this. I mean, my mortgage is, you know, I get notifications all the time. It’s like your mortgage has been sold cool. Now I have a new portal, a new I’m paying someone a new, you know, it’s like, okay, um, that’s interesting. What do you think is a solution for something like that?
Eli Carpio 16:51
Man, I just think, you know, as as a lien is being sold, you know, or as a mortgage is being sold, um, I think it’s, I’m going to say it’s on the bank and, you know, they’re so interested in the transaction of buying that mortgage, you know, sometimes, you know, they things just fall through the crack. And it just happens to be that it’s, most of the time, it is a lien, it is a lien. It is a lien release, you know. And so I just think they got to get one, they got to get better at it. Two, the fact that we’re an abstract state doesn’t really help, per se. You know, it’s only us in Iowa, right? We’re the only abstracts in America. So I think once, hopefully one day, we become a title state. I think it could really help out, you know, and making sure that all paperwork is digital and it’s not, yeah, paper, you know.
Yoni Schmidt 17:47
So can you explain the difference, I guess, for our listeners, between, you know, a title and an abstract state. What does that mean? What does that look like?
Eli Carpio 17:54
And so I’ll tell you. So I used to own some property out in Wichita, Kansas, and I remember getting the contract and I send it over within 10 days. They’re like, Oh yeah, we’re ready to close right? My eyes opened up. I was like, Yeah, close, right. This is the first time I ever had purchased anything outside of Oklahoma. And so, yeah, man, sure enough, went over there, closed probably it took me two days to get over there, but on the 12th day, I closed, and so I started doing some research, and I’m like, well, everything’s digital to me, you know? Yeah, title and everything is is just at their fingertips, right? They’re not depending on an abstract company to come drop off the whole history of a house from the time it was built till today. That is the packet. I wish I had one here with me so I could show you.
Yoni Schmidt 18:47
Yeah, but, I mean, I’ve been, I’ve been to the to the abstract, like, records that across the street from, like, first title, right? And, I mean, we looked at them, and they’re just, like, some of them are as thick as, like, Oh, I know it’s like a file cabinet. It’s crazy.
Eli Carpio 19:04
The other day I saw one for a condo, because, you know, condos, they get sold all the time. It was literally probably about this big and, you know, so basically the after is going to be from the day the the lot was bought. So the house or condo was built, every owner in between, every probate in between, every lien release in between, every adjustment to the property, every survey, I mean, everything you could think of, of a history of a house, right? Is in that is in that Abstrakt, you know, and versus title, I mean, it’s, it’s, it’s just more. It’s just a simple like, here’s the house, here’s the address, here’s a legal and if there’s any liens on it, you’ll see it on the title, right? And as that’s, that’s pretty much.
Yoni Schmidt 20:00
It so a lot simpler. And the for the attorneys, it’s easier too, because they don’t have to, you know, review this very thick file and try to understand, you know, how it changed hands, or what liens there were, and when were they were, when those were released, and all of that, right? So that’s interesting. Yeah, tell me, I guess, how do you stay current with, like, the ever changing regulations and that, you know, laws that are affecting the industry, in general, real estate, title, all of it.
Eli Carpio 20:32
I mean, yeah, we just, you know, it’s something that we always have to look into. You know, obviously our attorney is always on the lookout, right, for the new laws and changes and and all that. You know, with the whole, I think the the last one was, you know, you can’t buy land if you’re not a citizen or resident, right, right? That was huge. So that’s, that’s an extra, an extra document that we’ve had to add for people to come sign every time they buy a property. So that’s something, was that, like, two years ago or a year ago?
Yoni Schmidt 21:05
Yeah? And I think so there’s also another, this new rule, which I’m not sure, and I don’t necessarily really understand, and, you know, I should look into it. But if you’re a foreigner, right, you can’t hold a piece of real estate for more than five years in the state of Oklahoma, right, right, right.
Eli Carpio 21:22
And they did that, you know, because China was coming here and buying, you know, 1000 acres at a time, you know, to avoid that. That’s where they started that. And I think that’s why they started this other document as well, you know. So you know things like that. I mean, you know, whole wholesale thing that happened a couple years ago as well. Yeah, so, so, yeah, we, we definitely, you know, that’s our attorney’s job to make sure that laws and everything are being followed all you know at all times. And obviously, as an owner, I’m always pretty aware of the real estate laws, you know, or what’s coming up, or what the rumors are. You know, we have friends, right? We have a network, so somebody in our network is going to hear about is going to trickle down to us, and we’re going to hear about it, then we start our research. And so, you know, that’s, that’s also a good, good thing about having a large network in real estate, right? You it goes pretty far up, right? So, right? We know what’s coming before it, it, it’s, it’s written into law, yeah, we prepare ourselves, you know, to, right?
Yoni Schmidt 22:25
And you’ll do, and you’ll do a whole bunch. You can do a whole bunch of stuff at Empire, right, like creative financing, closings and all sales, and you know, you’ll work, and you know how to navigate those complex waters of those creative transactions.
Eli Carpio 22:40
Right. Yeah. I mean, you know, I would say wholesaling is big, right? Yeah, that’s, that’s one of our top transactions is wholesaling, the double close. And the assignments subject twos are fantastic, right? Yeah. And, you know, we gotta, you know, when you do a subject to you gotta do a land trust. Also explaining that as well, because some some investors don’t know that you got to do that and it’s just to protect them. So yeah, you know. So yeah, we handle all that stuff, owner to owner as well. Owner finance, we do as well. So yeah, I mean, we’re open to anything pretty creative, as long as, of course, we could stay within our compliance.
Yoni Schmidt 23:27
Yeah, within the balance of the law. Of course. Tell me, what advice would you give a new real estate investor, you know, who’s about to go through their first transaction, you know? And, of course, has to involve a title company.
Eli Carpio 23:40
Yeah. I mean.
Yoni Schmidt 23:42
What should they look for?
Eli Carpio 23:45
Look for in the property, or?
Yoni Schmidt 23:48
In the title, or, you know, in the in the process, in the abstract and the requirements.
Eli Carpio 23:55
The first thing I would say is, don’t take a seller’s word for what they think their property, the status of their property is, right, you know, like, I told you, we see so many times where they’re like, Oh, don’t worry about it. Titles clear. You can just go beat it, you know. And that’s all because closing. And then, you know, I have an instance right now, a friend of mine just bought a lot out in Cleveland County, right? And he bought the lot for 50 grand right by the lake. And what happened now, he built the house. He built a brand new house, beautiful lake house on it, and now he’s trying to sell it. Well. Now a probate needs to be done. You know, there’s issues with lien releases as well. There’s also issue with a survey where he built the property, and there was no survey for him to go off of. And he built it by accident. Some part of the, a little piece of the actual house, is on someone else’s lot.
Yoni Schmidt 24:54
So it’s encroaching on the lot next,.
Eli Carpio 24:58
Exactly. You know those things right there, man, that you know that’s why you have us. That’s why you have a title. No, it’s to make sure that what you’re buying is legit and what you’re buying is within you know the laws, and what you’re buying is, you know, we’re securing your purchase basically. So you know that’s just, that’s what I recommend, is don’t take a word, don’t take a chance, because it’ll be more expensive in the end.
Yoni Schmidt 25:29
Yeah, and do you normally recommend buyers get a survey?
Eli Carpio 25:38
We do, we do recommend it, especially if it’s a new build, you know, we want to make sure that you know your lot is exactly what you’re buying. You know, sometimes you’ll have those houses, you know, with 5, 10 acres, or, you know, that they don’t have any there’s no, like, dividing point or anything like that. You know, commercial is also big. Yeah, I would definitely get surveys on commercial because you never, you never know, especially buildings that are really close together, like downtown or something like that, right? That’s when we really recommend it. But if you’re just buying a, you know, like a newer home that just was built, and you have neighbors and all that, like, you know, yeah, you could probably, we probably have a pretty updated survey.
Yoni Schmidt 26:21
Yeah, because the older homes that you know, were built, say 80 years ago, 70 years ago, you know, if you, if you get a survey and there is some sort of like encroachment, or, you know, it’s on an easement, the chances of you being told this needs to come down are quite slim. It’s been that way for many, many years. And, you know, in certain cases this I, as I understand it, the city can release those, you know, those kind of like encroachments on easements, or, you know, it’s hard for a neighbor to say, Hey, you’re encroaching on my lot. It’s been like this for 70 years. Tear down your house, right for new builds, it’s something that you know that’s a big mess up on a builder’s part, if they weren’t staying within the bounds of that law.
Eli Carpio 27:09
Exactly.
Yoni Schmidt 27:13
Yeah, wow. Okay, a couple last questions. As an entrepreneur, what have what have been, you know, some of the most rewarding aspects of starting and growing your own businesses.
Eli Carpio 27:24
Man, you know, most people would say, like my success, right? But in reality, no, I, I, what I’ve seen is, with me growing a company, I see other people grow as well, you know? And so seeing other people grow is like, to me, that’s, that’s the most rewarding part, because you’re changing a life, right? Yeah, the way they think you’re changing their generation and their next generation, right? And so to me, that’s the most rewarding part, man. I mean, I’ve, I’ve taught a lot of people, and I’ve seen them, I see where they are now, and it’s like, it’s like, Hey, man, I mean, you know, a day of a day of my time, or, you know, a couple hours of my time has really trickled into this. And to me, that’s, that’s the best man.
Yoni Schmidt 28:10
So, yeah, I love that. That’s true. It’s a humbling experience, for sure. Okay, tell us, you know, looking ahead, what are your long term goals for Empire? Title, imposing. You know, how do you plan to achieve them? I know you. You told me, you know, before we hit record on this, you told me a little secret. I don’t know if it’s public yet, but if it is, and you want to announce it, go ahead.
Eli Carpio 28:34
We’ll be launching Empire Title in Oklahoma City. Yeah, we felt the a big need down there as well for a lot of bilingual, you know, bilingual services down there, from my understanding, there’s only one bilingual agent in Oklahoma City, and so, you know, we want to be able to bring our culture and our way of doing things to the OKC area. And, yeah, man, we’ve already been out there talking to a bunch of agents and vendors and and everyone’s super excited about it. You know, we’re excited about it. I know it’s going to, it’s not going to be easy traveling back and forth on that Turnpike, you know, at least every other day when, you know, when you open up, you got to be there every other day, at least, right? Oh, yeah, yeah, everything runs smooth and and so, but man, we’re excited about the challenge, and also, eventually, I’ll also open up another location here in Tulsa as well.
Yoni Schmidt 29:32
